These Terms & Conditions explain how we sell products through spiritofbritishmischief.co.uk and how you may use our website. Please read them before placing an order and keep a copy for your records.
Nothing in these terms limits your statutory consumer rights.
1. About us
This website is operated by G&D SPIRITS LTD, trading as G&D The Spirit of British Mischief. In these terms, “we”, “us” and “our” mean G&D SPIRITS LTD.
We are registered in England and Wales under company number 16566565.

These terms cover purchases made as a consumer for personal use or gifts. Trade and wholesale orders may be subject to separate terms agreed before the order is placed.
2. Age restrictions
You must be at least 18 years old to buy alcohol from us. You must not buy alcohol on behalf of anyone under 18, and anyone receiving an alcohol delivery must also be at least 18.
We or our delivery providers may request proof of age before completing a sale or delivery. If satisfactory proof cannot be provided, the order or delivery may be refused.
If we cannot fulfil an order because age requirements are not met, we will explain what happens next and refund any sums due in accordance with your legal rights. Any charge arising from a failed delivery must be reasonable, reflect costs actually incurred and be permitted by law.
3. Our products
The description on the relevant product page sets out what you are buying, including bottle quantity, volume, alcohol content and relevant allergen information. G&D contains sulphites.
Please read the product information before ordering and follow any storage or handling instructions supplied with the product.
Photographs show the product and may also show serving suggestions. Glassware, garnishes, props and other accessories are included only where the product description expressly says so.
Colours may look different on different screens, and packaging may change slightly. Any change must not materially alter the product you ordered or reduce your rights to receive goods matching their description. We will not substitute a different product without your agreement.
4. Prices and payment
Prices are shown in pounds sterling and include applicable taxes. Delivery charges are displayed separately before you pay.
The total payable, including any delivery charge and discount, will be shown at checkout. You can pay using the payment methods offered there. Payment is required when you place your order.
If we identify a pricing error before accepting an order, we will contact you. You can choose whether to proceed at the correct price or cancel for a full refund. We will not charge a higher price without your agreement.
Changes to our advertised prices do not alter the price of an order we have already accepted.
Any conditions attached to a discount or promotion will be made available before you order.
5. Placing and accepting an order
Please check your basket, contact details and delivery address before submitting your order. Placing an order is an offer to buy the products selected.
An automated email acknowledging receipt of your order does not, by itself, mean that we have accepted it. Your contract with us begins when we send an email expressly accepting your order or confirming dispatch, whichever happens first.
Before acceptance, we may be unable to fulfil an order because a product is unavailable, payment cannot be authorised, the delivery address is outside our service area, age requirements are not met or there is a genuine pricing or product-description error. We will let you know promptly and refund any payment taken for an order we do not accept.
If you spot a mistake after ordering, contact us as soon as possible. We will try to help, although changes may no longer be possible once dispatch is under way. Your cancellation rights remain unaffected.
6. Delivery
We currently deliver within the United Kingdom only.
Our current delivery options are:

Available options and the final charge are shown at checkout. Working days are Monday to Friday, excluding UK bank holidays. These delivery estimates start on dispatch, not on the day the order is placed. Priority delivery is not a guaranteed next-day service.
Unless we agree otherwise with you, we will deliver without undue delay and within 30 days of accepting your order. We will contact you if we become aware of a significant delay.
If we miss an agreed or legally required delivery deadline, you may require delivery within a further reasonable period. If we still fail to deliver, you may cancel the affected order and receive a refund. You may cancel immediately where we refuse to deliver, or where delivery by a particular deadline was essential and this was clear from the circumstances or you told us before we accepted the order.
We remain responsible for the goods until they are physically received by you or a person you have nominated to receive them. Our use of a delivery or fulfilment provider does not remove our responsibility to you.
Please provide a complete, accurate delivery address and arrange for an adult to receive the parcel. If a delivery fails because of an incorrect address supplied by you, a missed collection or an unmet age requirement, contact us so we can agree the next step. We will explain any reasonable additional delivery costs before arranging redelivery. This does not remove your statutory cancellation or refund rights.

7. Your right to cancel
If you buy as a consumer online, you may cancel your order without giving a reason from the time you place it until 14 days after the day you, or a person you nominate, receives the goods.
If products from one order arrive separately, the cancellation period ends 14 days after the day the last product is received.
To cancel, tell us clearly that you wish to cancel. You can email info@spiritofbritishmischief.co.uk, telephone us or write to the address in section 1. Please include your name and order number, if available, so we can identify the purchase.
You may use the cancellation form at the end of these terms, but you do not have to. You do not need our approval to exercise your cancellation right. It is enough to send your cancellation notice before the relevant deadline.
If your order has already been dispatched, you may need to receive it and return it using the process below.
8. Returns and refunds following cancellation
After notifying us that you wish to cancel, send the goods back without undue delay and within 14 days. Contact us for the correct return address and instructions. We will provide these promptly; a delay on our part in supplying instructions will not count against you.
For a change-of-mind return, you pay the direct cost of returning the goods. Please pack bottles securely and keep proof of posting. A tracked service is recommended. Original packaging is helpful but is not a condition of exercising your cancellation rights.
You may inspect the goods as you reasonably could in a shop. If handling beyond what is necessary to establish their nature, characteristics and functioning reduces their value, we may deduct that loss of value from your refund. Opening or consuming a bottle may substantially reduce its value. This does not affect your rights where goods are faulty or not as described.
If you cancel the whole order, we will refund the price paid and the cost of our least expensive standard delivery option. We do not have to refund the extra cost of a more expensive delivery service you chose. Where only part of an order is cancelled, any delivery refund will be calculated in accordance with your legal rights.
We will refund you without undue delay and no later than 14 days after receiving the returned goods or evidence that you have sent them back, whichever is earlier. If no goods were supplied, or we have offered to collect them, we will refund you within 14 days of being told of your cancellation.
Refunds will use the original payment method unless you expressly agree otherwise. We will not charge a refund administration fee.
9. Faulty, damaged or incorrect goods
We are responsible for supplying goods that are of satisfactory quality, fit for their purpose and as described.
If your order arrives damaged, leaking, faulty or incorrect, contact info@spiritofbritishmischief.co.uk. Your order number, a description of the problem and photographs where practical will help us resolve it. Photographs and original packaging are not conditions of your statutory rights.
You normally have a short-term right to reject goods that do not meet these standards within 30 days of delivery and receive a refund. After that period, you may have rights to a repair or replacement and, where the legal conditions are met, a price reduction or refund.
Any repair or replacement must be provided at no cost to you, within a reasonable time and without significant inconvenience. We will cover reasonable return costs for faulty, damaged, misdescribed or incorrect goods, or arrange collection where appropriate.
Please contact us promptly so we can help. A delay in reporting a problem does not by itself remove your statutory rights.
For a refund following a valid rejection of faulty goods, we will refund you without undue delay and within 14 days of agreeing that you are entitled to it.
10. Gifts
You may order for delivery to another adult as a gift. Please check their address and ensure that an adult will be available to receive the parcel.
Refunds are normally made to the original purchaser using the original payment method. A gift recipient can contact us about a problem, although we may need the purchaser’s details to identify the order.
11. Our responsibility for loss or damage
If we breach these terms or fail to use reasonable care and skill, we are responsible for loss or damage that is a foreseeable result. Loss is foreseeable if it is an obvious consequence or if we and you knew it might happen when the contract was made.
We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any liability arising from rights that consumer law does not allow us to exclude.
For purchases made as a consumer, we supply products for personal use and gifts. We do not accept liability under these consumer terms for business losses, such as lost profits or business interruption.
If events outside our reasonable control affect an order, we will take reasonable steps to reduce the impact and keep you informed. This does not remove your rights concerning delivery, cancellation, refunds or goods that fail to meet legal standards.
12. Using our website
You must not misuse the website, introduce malicious software, attempt unauthorised access or use it for unlawful purposes.
Website content, including our branding, text and photography, belongs to us or our licensors unless stated otherwise. You may browse, share links and save information for personal use. Other use requires permission unless permitted by law.
Links to third-party websites are provided for convenience. We do not control those websites or their content.
Maintenance or technical problems may occasionally affect website availability. This does not alter our obligations under orders we have already accepted.
13. Privacy and cookies
Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains how cookies and similar technologies are used.
Placing an order does not automatically subscribe you to marketing emails. Service messages about your order may still be sent where needed to fulfil it.
14. Questions and complaints
Please contact info@spiritofbritishmischief.co.uk or write to the address in section 1 if you have a question or complaint. Include your order number, if available, and explain what has happened.
We aim to acknowledge complaints within two working days and resolve them as promptly as possible. If we need more time, we will explain why and keep you updated.
If we cannot resolve a complaint, we will explain our position and provide any information about independent dispute resolution that we are required by law to give. Nothing in our complaints process prevents you from exercising your legal rights.
15. Changes to these terms and applicable law
We may update these terms for future orders. The version in force when you place an order applies to that order unless we agree a change with you or a change is required by law. Updates will not retrospectively reduce your existing rights.
If a court finds part of these terms unlawful or unenforceable, the remaining provisions continue to apply so far as legally possible. If we do not immediately enforce a right, that does not mean we have given it up.
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you also retain the protection of any mandatory consumer laws applicable where you live.
You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home country.
16. Optional cancellation form
Complete and send this form only if you wish to cancel your contract. You can instead send any other clear statement of cancellation.
